Welcome to Elastotype. By downloading, installing, or using Elastotype ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

By accessing or using Elastotype, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Software.

Elastotype is a macOS application that provides:

• Real-time spell checking for English and Korean languages
• System-level integration with macOS applications
• Experimental romanization-to-Hangul conversion (beta feature)
• AI-powered text processing with encrypted transmission

The Software is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Software on devices you own or control
• Use the Software for personal or commercial purposes

Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the Software
• Remove or modify any proprietary notices or labels
• Use the Software to violate any applicable laws or regulations
• Redistribute, sell, or sublicense the Software without permission
• Use the Software in any way that could damage, disable, or impair our services

You are responsible for:

• Maintaining the security of your device
• All activity that occurs through your use of the Software
• Ensuring your use complies with applicable laws
• Reviewing the accuracy of spell checking suggestions before accepting them

Elastotype uses AI-powered processing with encrypted data transmission. We:

• Do not permanently store your typed text or usage logs
• Do not collect personal information (names, emails, IP addresses)
• Do not share your data with unrelated third parties
• Do not require an account to use the Software

Text is processed through our AI service with encryption for spell checking and romanization. For more information, please review our Privacy Policy.

Certain features may be designated as "beta," "experimental," or "preview" (including the romanization feature). These features:

• Are provided for testing and feedback purposes
• May not work correctly or as intended
• May be modified or discontinued without notice
• Are provided without any warranties

The Software, including all code, designs, trademarks, and content, is owned by Elastotype and protected by copyright and other intellectual property laws. Your use of the Software does not grant you ownership of any intellectual property rights.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Software will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of spell checking suggestions

We do not guarantee that the Software will meet your requirements or that it will be compatible with all hardware or software configurations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWING SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Business interruption or system failure
• Errors in spell checking or text conversion

Our total liability shall not exceed $100 USD or the amount you paid for the Software (currently $0), whichever is greater.

You agree to indemnify and hold harmless Elastotype and its affiliates from any claims, damages, or expenses arising from:

• Your use of the Software
• Your violation of these Terms
• Your violation of any third-party rights

We may release updates to the Software to:

• Add new features or improve existing ones
• Fix bugs or security vulnerabilities
• Ensure compatibility with new macOS versions

Updates may be provided automatically or require manual installation. Continued use of the Software after an update constitutes acceptance of the updated version.

These Terms are effective until terminated. You may terminate at any time by:

• Uninstalling the Software from your device
• Ceasing all use of the Software

We may terminate or suspend your access immediately if you breach these Terms. Upon termination, you must uninstall the Software and destroy all copies.

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Your continued use of the Software after changes are posted constitutes acceptance of the modified Terms.

We will update the "Last Updated" date at the top of this page when changes are made.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Elastotype operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Software shall be resolved through:

1. Good faith negotiation between the parties
2. Binding arbitration if negotiation fails
3. Small claims court if the dispute qualifies

You waive any right to participate in class action lawsuits or class-wide arbitration.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elastotype regarding the Software and supersede any prior agreements.
